End User License Agreement

1. Agreement with Edukas Solutions

This End User License Agreement (“EULA”) is a legal agreement between you and Edukas Solutions LLC (“Edukas Solutions,” “we,” “us,” or “our”) for access to and use of Be You, including its website, game, public result pages, challenge links, media, and related services.

By checking the acceptance box and selecting “Accept and play,” you confirm that you have read and agree to this EULA and acknowledge the Be You Privacy Policy. If you do not agree, do not play or use the game.

2. Eligibility

You must be at least 13 years old. If you are in the European Economic Area, United Kingdom, or another jurisdiction that applies a higher digital-consent age, you must be at least 16 or the minimum age required there. If you have not reached the age of majority where you live, a parent or legal guardian must review and agree to this EULA for you.

You may use Be You only where doing so is lawful. You represent that you have the authority to enter this agreement.

3. Limited license

Subject to this EULA, Edukas Solutions grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use Be You for lawful, non-commercial entertainment.

Be You is licensed, not sold. Edukas Solutions and its licensors retain all right, title, and interest in the software, game systems, writing, visual design, audio, brands, and other content, except for third-party materials governed by their own licenses.

4. Fictional simulation; no professional advice

Be You presents fictional career, relationship, reputation, money, wellbeing, and life tradeoffs. It is not financial, legal, medical, mental-health, employment, investment, or other professional advice. Game outcomes, probabilities, labels, and endings are authored entertainment and should not be used to make real-world decisions.

The launch archetype and scenarios are fictional. Any resemblance to actual people, companies, events, or careers is coincidental unless clearly identified otherwise.

5. Rules of use

You may not:

• Copy, sell, rent, sublicense, republish, or commercially exploit Be You or its content without written permission.
• Reverse engineer, decompile, bypass access controls, extract source assets, or create unauthorized derivative services, except where applicable law expressly permits it.
• Interfere with the service, probe for vulnerabilities, introduce malicious code, overload endpoints, scrape at scale, or automate play in a way that harms users or infrastructure.
• Manipulate, forge, or misuse public result signatures, challenge lineage, guest identifiers, legal acceptance records, or game state.
• Use Be You to violate law, infringe rights, impersonate another person, harass others, or distribute harmful or deceptive content.

6. Gameplay data, public results, and challenges

Private runs are associated with a random guest cookie in the browser. Completed lives may generate public result and challenge URLs. Anyone with a public URL may view the fictional outcome, choices, comparison, and share image made available at that URL. You are responsible for deciding where and with whom to share it.

You retain no ownership interest in the underlying game content by making choices or generating a result. We may use aggregated, de-identified gameplay information to test and improve game balance and reliability. Our processing practices are described in the Privacy Policy.

7. Availability, updates, and termination

We may update, rebalance, suspend, or discontinue features, content, or access. Saved or public results may not remain available indefinitely. We may suspend or terminate access if you materially breach this EULA, create security or legal risk, or misuse the service.

You may stop using Be You at any time and may use the in-app data deletion control to remove data associated with the current guest browser. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability limits, and dispute terms, will survive.

8. Third-party services and open-source software

Be You relies on third-party infrastructure, including Vercel, and may contain open-source software. Third-party services and open-source components are subject to their own terms and licenses. We are not responsible for third-party services outside our control.

9. Disclaimers

To the maximum extent permitted by law, Be You is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, accuracy, or freedom from errors. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, Edukas Solutions and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, opportunities, goodwill, or business interruption arising from Be You.

Our total liability arising out of or relating to Be You will not exceed the greater of the amount you paid for Be You during the twelve months before the event giving rise to the claim or one hundred U.S. dollars. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.

11. Governing law and disputes

This EULA is governed by Delaware law, without regard to conflict-of-law rules, while preserving any non-waivable consumer protections that apply where you live. Before filing a formal claim, you and Edukas Solutions agree to attempt good-faith resolution by written notice.

If a dispute is not resolved informally or through mutually agreed mediation, it will be resolved by binding individual arbitration in Delaware under the applicable American Arbitration Association rules, except that either party may bring an eligible claim in small-claims court. To the extent permitted by law, disputes must be brought individually and not as a class, collective, or representative action. Nothing here prevents either party from seeking urgent injunctive relief for security or intellectual property misuse.

12. Changes and general terms

We may update this EULA. Material changes will receive a new legal version and require acceptance before your next life begins. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign this EULA without our consent; we may assign it as part of a reorganization, financing, merger, acquisition, or sale of assets.

This EULA and the Privacy Policy are the complete agreement for your use of Be You unless another written agreement with Edukas Solutions expressly applies.
